This is not relevant to what you're saying, but I do want to clarify that this is not related to the judiciary. Immigration courts are not Article III courts (judiciary) but are in fact part of the executive branch.
The judges are in fact employees of the Executive Office for Immigration Review (EOIR), which reports to the Attorney General.
This is a big part of why the due process rights of the immigrants are relatively limited compared to what they would get if they were (for example) in a criminal court being accused of a crime.
This also means that the judges are not really independent of the government; a judge who doesn't rule the way the government wants can simply be fired by the President or the AG which obviously is not the usual process for a normal judicial court.
This is absolutely hellish. I've seen the photos of tiny three-year-olds sitting before the courts "representing themselves" before a judge, barely able to see over the top of the table. In what insane world is this considered due process.
Children have almost no rights under the best of circumstances, and these are the worst possible circumstances. As a parent, I cannot conceive of how anyone could treat a child this way, they are the most vulnerable people on earth, and what we do to them, how we treat them, the respect and kindness we do or do not show them is the thing that determines if we have any decency at all. Wild animals treat children better than this.
Immigration judges are not barred judges. They're bureaucratic executives. Their judgment is entirely careerist whim, unaccountable to even the US Constitution, and really only accountable to the US President, as their boss.

This is the kind of thing history will look back on and ask what was wrong with us? “Americans continued the illusion of their beloved justice system by bringing small children in to plead their immigration case to an administrative court.”
