I feel like the people who have demonstrated thoroughly their disregard of basic decency won’t be curbed by law. That’s not to say we shouldn’t try, but I wonder what effect a law against AI-made revenge porn would have.
Theyd have to enforce it on all levels globally like they do kiddie porn. No one can manufacture, create software to manufacture, distribute or be in possession of it. Thats what it would take. There just isn’t the will for that level of enforcement.
And beyond that, there's no longer a need for specialized software to make a deepfake. There would need to be guardrails built into all image editing software to restrict the portrayal of a human being without proof of permission to use their likeness. Without that level of restriction, I don't see what technical solution could actually come close to stopping this. Unless the goal is to be able to punish photoshop for existing, laws banning the software will either be so narrow as to be useless or so broad as to catch a lot of software not intended for this use.
Going after software that specifically advertises itself for this purpose is good, but we'd also have to have mechanisms for punishing the individuals who use the software to create deepfakes.
Maybe they could just cast a net and target only software that's specifically advertising its ability to do this, that might catch a good amount of the content that's being put out there. Then, they can start going after hosting services and individuals for owning and distributing this type of material.
That's how a lot of laws work anyway, by creating a barrier, and in order to cross that barrier you have to have intent which is the thing that lands you specifically in jail.
If we just had laws that prevent the sharing of this content globally, but we don't.
You can find borderline CP or actual CP (AI generated) and nobody will do anything even if you report it. The site admins won't care because the local jurisdiction can't do anything and they get $$ for ads on the site anyway.
