Castle Rock v. Gonzales (2005): A woman had a restraining order against her ex-husband for herself and her three daughters. He kidnapped them. She contacted the police multiple times asking for them to enforce the restraining order; each time they declined to do anything. He rolled into the police station in the early morning hours and started shooting; they shot back and killed him. In the trunk of his car were the three daughters he murdered.
The Supreme Court ruled that the cops had no duty to enforce and that it "wasn't mandatory". The system doesn't want to protect you.
At least the crime victims office is honest with you. They'll tell you the PFA is only a piece of paper. My ex put a photo of a gun he had on social media after he relinquished his guns under the PFA and the state police didn't do anything, because they were mad about the paperwork involved. They fought with me that night over the phone and said it was my county's responsibility even though the violation happened in theirs. It's so fucked.
Why do we even have law enforcement if they have no obligation to enforce the law? Why have mountains of paperwork and miles of regulations that mean nothing? What’s the point of any of this if the system runs on “hope everyone always follows the law and do nothing about it if they refuse”?
This happens too often. And the women who kill their abusers in self-defense are also penalized.
Not sure if you heard about Keisha Golden. She was set to go to trial for murder last month. She had called 911 fifty times in a two year period from the abuse, had a restraining order in the past, and had previously survived strangling incidents.
He came back and began to assault her while she was 8 months pregnant. And she shot him. And suddenly they wanted her to go to jail. Come on.

I'll save you a read, the system failed her because abusers run the system. Seriously, a cop got arrested for using flock to stalk his ex, and that's just one of them. The 40% statistic is outdated.
After I got my protective my order, my ex harassed me for a year. I had to appease him every time because I was utterly ALONE. It is terrifying. My first experience with police after reporting the abuse was horrifying.
After I moved, he harassed me. Bragged about how he had friends in high places. I finally called the police in my new town. The police actually did something. They arrested him and he plead guilty for violating the protective order.
This was in Texas. Shocker. Oh and years later, my ex was endorsed by none other than Ken Paxton. I hope they both rot in hell.
Unfortunately, you can’t rely on a restraining order. It’s just a piece of paper. If someone is intent on hurting you, then they have nothing to lose. The threat of going to jail will not stop them.
The best thing to do is get away, get a police paper trail started and disappear completely. I know it’s harder to do when minor children and custody are involved, like in the article, but I’d rather be alive and in legal trouble than dead.
Same thing happened in Sacramento last week. Woman killed by her stalker. She had a restraining order and he violated it several times with no repercussions.
