Clean water isn't a constitutional issue. Clean water isn't mentioned in the Constitution.
This doesn't mean that they have no recourse because there are laws pretty much guaranteeing clean water. This should have been filed in State court or with the Federal EPA.

This is a political problem in Mississippi. The great majority of Jackson, MS residents are black. The white people live outside of Jackson and are served by other water treatment plants. They have been fucking with this water issue for decades because of blatant racism. That is the real issue.
Not as a violation of the constitution. Potentially as a violation of other laws. And legislatures are free to pass new laws protecting drinking water, preventing contamination, etc. anytime.
It’s sounds outrageous that people should not be guaranteed access to clean water. But the constitution is pretty old and the framers of the constitution never mentioned it. They probably couldn’t conceive of a time when people wouldn’t have access to clean water (or maybe didn’t care. They were the privileged elite.) Don’t forget, 1789 was before the Industrial Revolution. Medicine was far from modern, as we would view it. There was no water treatment other than diluting human and animal waste by discharging it into waterways such as rivers.
Germ theory was in its infancy at that time.
As the other commenter said, there was nothing to preclude legislation to protect access to clean water, but that’s not the same as the constitution.
And for the record, I think access to clean water should be guaranteed as well as the other things you mentioned. And I’m not a legal scholar. Maybe there are some amendments such as those that guarantee equal protection under the law that actually require those things. To be honest, I’m kind of sorry I even replied to this thread.
Access to clean water, air, etc and untainted food and drugs should be available to anyone who needs them. My only point was to say that those come from acts of congress such as those that created the FDA and EPA and probably others I’m not aware of. The power of these agencies shouldn’t be eroded or limited.
Life, Liberty, and the pursuit of happiness anyone? Need clean water to live, right? Everything that comes out of this current administration is for the betterment of a handful of people not for the People. This so so goddamn gross.
